Photographer Services Agreement

This Photographer Services Agreement (the "Agreement") is between InstantPix Technology Private Limited (CIN U62011KA2026PTC221385), operating the InstantPix platform ("InstantPix", "we", "us"), and you, the photographer or studio applying to offer services on the platform ("you", "Photographer"). By accepting, you agree to be bound by it.

You must be at least 18 years old, legally able to contract in India, and complete identity (KYC) verification before going live or accepting bookings. You must maintain a valid Indian bank account for payouts. InstantPix may decline or revoke onboarding at its discretion.

You warrant that all information you provide — identity, KYC documents, portfolio, pricing, service area and availability — is true, current, and your own. Submitting false, forged, or third-party identity documents is grounds for immediate suspension and may be reported to authorities.

Once a booking is confirmed (on receipt of the customer's 30% advance), you commit to attend and deliver the agreed coverage. You will respond to requests promptly, honour the quoted scope, and deliver edited photos within the timeframe you state. You may not solicit customers to transact off-platform to avoid platform fees.

After the advance is paid the booking is confirmed; you may not unilaterally cancel a confirmed booking except in a genuine emergency, in which case you must notify InstantPix and the customer immediately and the customer is refunded in full. Customer cancellations follow the platform Cancellation Policy (currently 100% refund 24h or more before the event, 75% within 24h). A confirmed no-show (failing to attend a paid booking) results in a full customer refund, a strike on your account, and possible suspension. Repeated cancellations or complaints may lead to removal.

The platform fee is charged to the CUSTOMER; your payout is the full quoted amount for the booking, less any amounts already settled in cash and less applicable taxes/withholding required by law. Payouts are released AFTER the booking is completed, to your verified bank account via our payments partner. The commission/fee structure, payout schedule, and any minimum threshold are shown in your Dashboard and may change with prior notice. You are responsible for your own income taxes and, where applicable, GST on your services.

You retain copyright in the photographs you create. You grant the booking customer the usage rights agreed for their event, and you grant InstantPix a limited, royalty-free licence to store, process (including AI face-search indexing strictly to deliver photos to the people in them), display, and deliver the photos through the platform for that booking, and — only with separate opt-in — to feature samples for promotion. You must have the necessary consents from subjects for biometric face-search processing and must not upload content you have no right to distribute.

Event photos may be processed with facial recognition to match attendees to their photos. You must respect attendee privacy, not misuse any personal or biometric data you access, and comply with applicable Indian data-protection law. InstantPix handles KYC and biometric data under its Privacy Policy.

You will act professionally and lawfully, treat customers and their guests with respect, and not engage in harassment, discrimination, or any unlawful or unsafe conduct at events. InstantPix may investigate complaints and act on them.

InstantPix may suspend or terminate your account for breach of this Agreement, fraud, false KYC, repeated cancellations or no-shows, customer-safety concerns, or legal requirement. On termination, payouts for already-completed bookings are processed; disputed amounts may be withheld pending resolution. You may stop offering services at any time, subject to honouring already-confirmed bookings.

We may update this Agreement. When the version changes you will be asked to review and accept the new version before you can continue accepting or acting on bookings. Continued use after a new version is accepted constitutes agreement to it.

This Agreement is governed by the laws of India. The courts at Bengaluru, Karnataka have exclusive jurisdiction over any dispute arising out of or in connection with it.
