Terms of Service

These Terms of Service govern your use of the InstantPix website, mobile app, and API (collectively, the "Platform"), which are operated by InstantPix Technology Private Limited (CIN: U62011KA2026PTC221385), a company incorporated in India with its registered office at C/o Kowshik Ashirwad Apts, 2nd Flr, New Extension Road, Dharmaram College, Bangalore South, Karnataka 560029. References to "InstantPix", "we", "us" or "our" mean InstantPix Technology Private Limited.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform. These Terms constitute a legally binding agreement between you and InstantPix Technology Private Limited.

You must be at least 18 years old to use InstantPix. By registering, you represent that all information you provide is accurate and that you have the legal capacity to enter into this agreement.

You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at support@instantpixapp.com if you suspect unauthorised access. We are not liable for losses caused by unauthorised account use.

Account sharing is prohibited. Each account must represent a single individual or legal entity.

For clients:

• Book photographers only for lawful purposes
• Provide accurate event details (date, location, type, budget)
• Pay the agreed amount via Razorpay before the event
• Treat photographers with respect at all times

For photographers:

• Maintain an accurate, up-to-date profile and pricing
• Accept or decline bookings within 48 hours of request
• Fulfil booked assignments professionally and on time
• Not contact clients outside the platform to circumvent payments

Prohibited for all users:

• Fraud, impersonation, or misleading content
• Uploading illegal, obscene, or defamatory content
• Circumventing platform fees
• Scraping, hacking, or reverse-engineering the platform

All payments are processed via Razorpay. By making a payment, you agree to Razorpay's Terms of Service.

Platform commission: InstantPix deducts a commission (displayed at checkout) from each booking. This fee covers payment processing, platform maintenance, and customer support.

Photographer payouts: Payouts are processed weekly to the photographer's registered bank account after the event is marked complete. A minimum payout threshold may apply.

Currency: All prices are in Indian Rupees (INR) inclusive of applicable GST.

You retain ownership of content you upload (photos, portfolio images). By uploading, you grant InstantPix a limited, non-exclusive, royalty-free licence to display, store, and transmit that content solely for platform operation.

InstantPix owns all platform code, design, AI models, and trademarks. You may not reproduce or distribute platform materials without written consent.

Event ownership. The user who creates an event ("organiser") owns the event metadata, the gallery, and all access decisions. The organiser is solely responsible for the lawful collection, use, and distribution of media uploaded to the event.

Editors & guests. Organisers may grant Editor access to delegated users for uploads and moderation. Guests may join via event code, link, or QR and download photos that match their own face. Guests may not redistribute other users' photos without consent.

User consent. Organisers must ensure that all photographed individuals have given appropriate consent for their images to be uploaded and processed by AI face-matching, in accordance with applicable Indian law (including the DPDPA 2023).

Event deletion. Organisers may delete an event at any time. Deletion removes the gallery, embeddings, and access for all guests and is irreversible after 30 days.

InstantPix uses face recognition to help users discover their own photos within an event gallery. By using face search, you acknowledge that:

• Selfies submitted for searching are converted into numerical embeddings, used in real time, and discarded immediately. The original selfie image is not retained.
• Face matching is best-effort and may produce false positives or false negatives, particularly under poor lighting, occlusions, or low-resolution inputs.
• The platform searches only the specific event gallery the user has joined — never the public internet, never other events, never other users' private galleries.
• Face data is never sold, never shared with advertisers, and never used to train third-party models.
• Users may opt out of being indexed by an event organiser by contacting the organiser directly or emailing support@instantpixapp.com.

InstantPix respects intellectual property rights and complies with applicable Indian law (including the Copyright Act 1957 and the IT Act 2000).

If you believe content on the platform infringes your copyright, send a written notice to support@instantpixapp.com including:

• Identification of the copyrighted work
• The exact URL or event code where the infringing content appears
• Your contact details
• A statement, under penalty of perjury, that you are the rights holder or authorised to act on their behalf
• Your physical or electronic signature

We will review and, where appropriate, remove the content within 7 business days. Repeat infringers will have their accounts terminated. For counter-notices, write to the same address.

To the maximum extent permitted by law, InstantPix is not liable for:

• Actions or omissions of photographers or clients
• Loss or damage to event media after upload to the platform
• AI photo search accuracy (results are best-effort)
• Losses from payment disputes resolved by Razorpay
• Indirect, incidental, or consequential damages

Our total liability in any dispute is limited to the amount you paid for the specific transaction giving rise to the claim.

We may suspend or terminate your account at any time for breach of these Terms or at our discretion with 7 days' notice. You may delete your account at any time from Account Settings. Pending bookings must be resolved before account deletion.

In case of a dispute between a client and photographer, both parties must first attempt resolution via the InstantPix support portal. If unresolved within 14 days, the matter shall be referred to arbitration under the Arbitration and Conciliation Act 1996, with the seat at Bengaluru, Karnataka, India.

These Terms are governed by the laws of India. Any legal action not subject to arbitration shall be brought exclusively in the courts of Bengaluru, Karnataka.

We may update these Terms. Material changes will be communicated via email at least 14 days before taking effect. Continued use constitutes acceptance of the updated Terms.
